NATIONAL HUMAN RIGHTS COMMISSION, INDIA vide order dated 25.5.2018 had pronounced a sentence for a term of 15 days and a fine of Rs.2000/- to the accused Shri Bhagwat Swaroop Meena u/s 16 of the Bonded Labour System (Abolition) Act 1976. Cancellation report has been filed in the Hon’ble Court accordingly and next date of Hearing the matter was fixed for 020.08.2018. The Bonded Labour, Shri Walter Karketta @ Raju, aged about 40 years was rescued on 9.2.2017 in a joint raid and release certificate was issued on 11.5.2017. When last contacted, he was living in Najafgarh, Delhi. A claim petition bearing MW/SD/627/2017/ 5996 under Minimum Wages Act was pending before the office of Labour Commissioner, Pushp Vihar, New Delhi to decide compensation / past wages. iv. The SDM, Defence Colony, New Delhi, vide his communication dated 3.8.2018 has submitted that Shri Walter Kakreta was rescued and declared bonded labour, vide their order dated 11.5.2017. The Summary Trial under the provisions of Bonded Labour System (Abolition) Act 1976 has already been completed and the ADM(SE) has convicted the employer with imprisonment of 15 days & a fine of Rs. 2000/-. v. The Labour Department was also directed to take necessary action for recovery of dues from the employer of the rescued bonded labour. Deputy Labour Commissioner, vide letter dated 16.8.2017 has been asked to launch a prosecution against the errant employer for violation of Labour Laws and also for recovery of past wages of the victim. Further, a cheque of Rs.20,000/- under the Central Sector Scheme for Rehabilitation of Bonded Labour has already been sent to District Magistrate, Gumla for disbursement to concerned. The Bonded Labour Fund has already been created by the Govt. of NCT of Delhi with Rs.10 lakhs in each district at the disposal of District Magistrate for immediate financial assistance to rescued Bonded Labourers as a financial assistance. vi. The Labour Commissioner, Jharkhand, Ranchi, vide communication dated 06.11.2018 has submitted that the victim is based in Delhi and therefore the process of rehabilitation could not be concluded. However, the District Vigilance Committee under the Chairmanship of Deputy Commissioner, Gumla was taking further steps for rehabilitation of the released bonded labourer. The Sub-Divisional Magistrate, Defence, Colony, South East District, Delhi submitted that the errant employer has already been convicted and sentenced with imprisonment of 15 days and fine of Rs.2000/-.The Labour Department has already been directed for recovery of past wages and prosecution under Labour laws. A cheque of Rs.20,000/- as interim relief under Central Sector Scheme has been sent to District Magistrate, Gumla, Jharkhand for disbursement. Copies of the relevant documents have also been annexed. The Labour Commissioner, Govt.of Jharkhand vide his further communication dated 16.11.2018 has submitted the total amount of Rs.1 lakh under the Central Sector Scheme has been paid to the victim. The victim has also been granted pension and extended benefits under Social Welfare Schemes. The Joint Labour Commissioner (S) Govt. of NCT of Delhi has submitted that the process for recovery of past wages and prosecution for violation of labour laws were already been launched against the ANNUAL REPORT 2018-19 67
