The Commission consider the matter on 09.07.2018 and inter alia observed that since the report of the Director, Electrical Safety, Uttar Pradesh, Lucknow, revealed that Smt. Surati Devi had died due to electrocution of snapped wire, and this happened due to negligence of the maintenance staff of the Department, as such it implicit that the human rights of the deceased were violated, for which the State is vicariously liable to make reparations to the next-of-kin of the deceased. The Commission directed to issue a notice under Section 18(a)(i) of the Protection of Human Rights Act, 1993, to the Government of Uttar Pradesh, through its Chief Secretary, requiring it to show cause within six weeks as to why the Commission should not recommend payment of Rs.100000/- as compensation to the next-of-kin of the deceased Smt. Surati Devi, who died due to electrocution on 10.10.2015. iv. The Commission considered the matter on 29.10.2018 and has observed that in response, the Principal Secretary to the Government of UP vide communication dated 10.07.2018 has intimated the Commission that Rs. 2 00,000 as compensation has been paid to the next-of-kin of Smt. Surati Devi through DM Basti. The DM Basti was directed to send within six weeks proof of payment of Rs. 2 00,000 compensation paid to the next-of-kin (NoK) of deceased Smt. Surati Devi. Electrocution death of one Virendra of village Dharampur, PS Mugrabad-Shahpur, District Jaunpur, U.P. due to the negligence of the officials of the Electricity Department. (Case No. 9617/24/39/2018) i. The Commission received a complaint from Shri R.H. Bansal, a human rights activist, Ghaziabad, Uttar Pradesh drawing the attention of the Commission towards an incident in which the electrocution death of one Virendra of village Dharampur, PS MugrabadShahpur, District Jaunpur on 16.03.2018 due to the negligence of the officials of the Electricity Department. ii. Pursuant to the directions of the Commission, the Executive Engineer, EDD Machlishahar, Pashchimanchal Vidhyut Vitran Nigam Limited, District Jaunpur, Uttar Pradesh has sent a report stating that on 16.03.2018 Virendra Yadav climbed on the Neem tree near the 33 KV line to pluck a branch of the tree and came in contact with the wire of the 33 KV line and died. Shri Virendra Kumar Yadav died due to his own carelessness. As per the inquiry report, the incident took place due to non-maintenance of 33 KV electrical lines, according to the Rules, Junior Engineer Lineman and other maintenance personnel are responsible and the next-of-kin of the deceased should be compensated. iii. The Commission considered the matter on 18.12.2018 and issued a notice to the Principal Secretary, Department of Energy, Government of UP requiring him to send a reply as to why the Commission should not recommend Rs. 1,00,000/- as compensation to be paid to the next-of-kin of the deceased Virendra Kumar Yadav.
