The Govt. of Rajasthan instead of complying with recommendations of the Commission
stated that as per the report received from the SP, Tonk, the victim girls were neither
assaulted nor tortured by the Police They suffered injuries during the stampede. The Govt.
of Rajasthan requested to close the matter.
vi.
The Commission considered the matter on 27.07.2018, when it rejected the explanation
furnished by the Govt. of Rajasthan. The Commission reiterated its earlier recommendation
and directed the Chief Secretary, Govt. of Rajasthan to pay a sum of Rs. 25,000/- each as
monetary relief to the seven school girls who sustained injuries due to lathi charge by the
Police. Compliance report along with proof of payment is still awaited.

The Commission came across a distressing news report captioned “Charged with
terror, damned by aliases”, that appeared in ‘The Hindu’ dated 07.02.2014. It carved the
incredible story of a boy ‘terrorist’ Mohammad Amir whose youth was destroyed because
of his wrongful arrest and 14 year long incarceration. Amir, who had just turned 18, was
ambushed by a police van on 01.02.1998 and a month after he found himself in the capital’s
Tihar Jail with the charges of murder, terrorism and waging war against the nation. He was
named the main accused in 20 low intensity bomb blasts executed between December,
1996 and October, 1997 in Delhi, Rohtak, Sonepat and Ghaziabad. Five explosions occurred
during a single evening in places as wide apart as Sadar Bazaar in Delhi and Ghaziabad,
many miles away. The charge sheet filed in April 1998 said that Amir had been trained in
Pakistan by the dreaded Abdul Karim ‘Tunda gang’. It was also mentioned that Amir and
co-accused Shakeel collaborated to make bombs out of a factory rented by Shakeel in
Pilakhua, Ghaziabad, U.P. Amir and his co-accused Shakeel were charged with physically
planting the bombs. However, Shakeel was discharged before the start of hearing in ten
cases but in 2009 he was found hanging from the ceiling of his barrack in Dasna Jail. Then
Superintendent of Dasna Jail V K Singh was charged with Shakeel’s murder.

As per the news report, Amir left for Pakistan in December, 1997 to visit his sister who
was married to a family in Pakistan and returned on February, 1998. A fortnight later he
was arrested on the charges of executing the bomb blasts subsequent to his training
in Pakistan. The last of the bomb blast was in October 1997 i.e. two months before he
went on his first and last trip to Pakistan. Amir who was confined in a solitary high
security cell for 14 years, lost his father without knowing about his death and his mother,
also suffered a brain haemorrhage, losing her voice and became paralytic. Amir was
acquitted in 18 of the 20 terror cases for want of evidence against him. Chandrabhan the
witness connecting him to the blasts, on whose evidence the entire terror case rested,
refused to support the prosecution during the trial and stated that he had never seen
