the better protection of human rights and those required to ensure good governance. To argue
otherwise, is to create a false dichotomy between human rights and good governance and to
misread the intrinsic relationship between them. A central purpose of good governance, in the
scheme of our Constitution, is to protect the Fundamental Rights contained in Part III, to observe
the Directive Principles of State Policy contained in Part IV, to uphold the laws enacted by
Parliament and to fulfill in good faith the treaty obligations entered into by the State.
