Recommendation to the Committee on Economic, Social and Cultural Rights (CESCR): 8. To urge the GoI to immediately improve regulations related to the pharmaceutical system, and institutional governance and coordination related to health services and drug control to prevent similar incidents from occurring in the future. 9. To urge the GoI to apply business and human rights principles to the pharmaceutical industry, including victims' access to remedies. 10. To urge the GoI to provide documentation of a good practice on non-legal remedies for the protection of right to health of the victims in the case of kidney failure in Indonesia. National Strategic Project Indonesia (PSN) and Agrarian Conflict 11. Komnas HAM recorded 2,275 cases of agrarian conflicts that occurred in the last 4 years. The eruption of agrarian conflict occurred in 2022 as many as 603 cases and in 2023 as many as 582 cases. Even though the figures shown in agrarian conflicts in 2023 was decreasing, the situation still shows that the mechanisms and efforts to resolve agrarian cases remain challenging. 12. In addition to the regular agrarian conflicts occurring, the recent GoI initiative - called the National Strategic Project Indonesia (PSN), has shown specific patterns of agrarian conflict. 13. The list of PSN’s projects updated at the end of 2022 with the issuance of Coordinating Minister for Economic Affairs Regulation Number 21/2022, which include 14 sectors, and 12 programmes. The 14 sectors include roads, dams and irrigation, area, railways, plantation, energy, clean water and sanitation, airports, tourism, education, seawall, technology and housing. Meanwhile, the 12 PSN programmes include the special economic zone (SEZ) programme, the sugar and palm oil industry programme, the smelter programme, the superhub programme, the electricity programme, the economic equality programme, the toll road exit access programme, the food provision programme, the strategic tourism area programme, the waste management installation programme, the border area programme, and the area development acceleration programme includes IKN (Nusantara Capital City). 14. In 2023 Komnas HAM received several complaints from communities concerning the PSN projects. The reported cases include issues regarding land allocation, compensation, and relocation of local communities. 15. In 2023 Komnas HAM handled a case of the right to welfare concerning the nominal compensation between residents of Karangrejo Village and the Land Acquisition Committee for the Construction of a PSN project - the Semarang-Demak Toll Road in Demak Regency.
