Link the department/agencv with a specific riqht or riohts and analvze the level of
enioVment or non-eniovment of the riqht(s), pavinq close attention to those most vulnerable. lt
is important for the departmenVagency to determine which human right or rights it promotes; a
department may support the realization of more than one right. For example, the Department
of Health supports not only the realization of the right to the highest attainable standard of
health, but also the rights to adequate food, water and sanitation, adequate housing, work and
education. Once the right or rights have been identified, claimholders, duty bearers and other
actors then determine whether and to what extent the right is enjoyed, particularly by women,
children, indigenous peoples, persons with disabilities, older persons, persons living with HlV,
migrant workers, and persons living in poverty. There is a full range of human rights based
tools available for situation analysis; these are described in the HRBA to Development Planning
Toolkit of the National Economic and Development Authority, specifically the section entitled
"Human Rights Based Approach to Assessment."
A word of caution: analysis is often dependent on available statistics. Budgeting for the
realization of the right to the highest attainable standard of health, for example, would entail a
clear and full understanding of the country's epidemiological profile, including a review of the
Philippine National Health Accounts, National Nutrition Survey, population statistics, etc. But
there is a considerable time-lapse between the period the data covers and the date the data is
released to the public. The 2007 Philippine National Health Accounts, for instance, were
released to the public three years later, in 2010. Budgeting based on data that is no longer
