Ten. Nominate a member
10.1. Within two working days after the appointment hearing in accordance with Article 9.1 of this
Regulation, the Working Group shall meet and decide to nominate a Commissioner of the Commission
and the Commissioner in charge of National Preventive Mechanism against Torture.
10.2. At the working group meeting, the rapporteur will present the report regarding the participant and
other members may ask questions related to the report. The working group will not use anonymous or
unvalidated information to evaluate participants.
10.3. Based on the application for candidacy, documents collected, information, results of the hearing,
and the report of the rapporteur, the Working Group shall select the participant based on the evaluation
of whether the candidate meets each of the requirements set forth in Articles 2.1 and 2.2 of this
regulation.
10.4. The members of the working group shall unanimously decide to nominate one participant with the
highest qualifications with regard to the requirements set forth in Articles 2.1 and 2.2 of this regulation.
If it is not resolved unanimously, it shall be decided by the majority vote of the members present at the
meeting, and the member who became a minority shall write dissenting opinion together with the
reasons and attach it to the report specified in 10.5 of this regulation. A member of the working group
shall have one vote and one vote shall be counted equivalent to one point.
10.5. The report on the shortlisted candidate shall be prepared in accordance with Article 10.4 of this
Regulation and signed by the members of the Working Group who participated in the meeting:
10.5.1. the reasoning on why the candidate is deemed to have the highest qualifications by the
Working Group in line with the requirement set forth in Articles 2.1 and 2.2 of this Regulation and is best
suited to appointed as Commissioner of the Commission or in charge of National Preventive Mechanism
against Torture;
10.5.2. Confirmation that the selection process was conducted in accordance with the law and this
regulation.
10.6. The working group shall submit a report and relevant documents to the Standing Committee on
Legal Affairs of the State Great Khural within three working days from the date of selection of the
candidate.
10.7. The report specified in Article 10.5 of this regulation shall be posted on the website
www.parliament.mn within a week and announced to the public through the media.
10.8. The Standing Committee on Legal Affairs shall submit a proposal and conclusion on whether the
candidate selected by the Working Group meets the requirements for the Commissioner of the
Commission to the plenary session of the State Great Khural.
