Box-17 While receiving a charge-sheet, the Court shall: S.173(1)Cr.P.C 1. Ensure that the charge-sheet has been filed on the completion of investigation without unnecessary delay. S.173(2). 2. Ensure that, on completion of investigation, S.H.O shall forward to the appropriate Magistrate a report stating the details enumerated in Section 173(2) (1) S.173(5) 3. Ensure that, along with the charge sheet, all documents or relevant extracts thereof, on which the prosecution proposes to rely and the statements recorded u/s 161 IPC of all the persons whom the prosecution proposes to examine as its witnesses, are also filed. S.173 (6) 4. Ensure that, where the police officer is of the opinion that any part of the statement or information be withheld in the interest of justice or public expediency, he should request the Magistrate stating in writing the reasons for such a request. S.173(8) 5. Ensure that nothing in the aforesaid provision should inhibit further investigation and subsequent report where evidence is found after filing the report. S.173(1A) Cr.P.C 6. Ensure that the investigation in relation to rape of a child be completed within 3 months of the FIR. 30
