While effecting arrest, the enforcement authority shall:
Art. 21of the Constitution.

Ensure that no person is deprived of his/
her right to life or personal liberty, except
in accordance with a procedure
established by law.

Ensure that the arrestee is informed of
the full particulars or the grounds
for arrest
3.
Ensure that no person is denied the right
to consult and be defended by a legal
practitioner of his/her choice.

4.
Ensure that the accused is produced
before the nearest Magistrate within 24
hours, excluding the time taken for
travelling from the place of arrest to the
Magistrate’s court.

5.
Ensure that a person arrested without a
warrant for a bailable offence is informed
that he/she is entitled to be released on
bail, so that he may arrange for sureties.

6.
Ensure that a friend or relative or other
person who is known to him/ her and is
likely to take interest in his/her welfare,
is informed about the fact of arrest and
the place where he/she is being detained.

7.
No woman shall be arrested after sunset
and before sunrise without a proper
permission of the Judical Magistrate.
