These rehab centres operated under the same type of legal permit -- a foundation -- issued by the Ministry of Law and Human Rights, accompanied by a permit to deliver social rehabilitation services from the Provincial Department of Social Affairs; 36. While these institutions have obtained permits for the establishment and implementation of social rehabilitation services, they have never received supervision and evaluation from the relevant authorities. On the other hand, the government does not yet have a standard for privately-managed social rehabilitation centres and its monitoring mechanism. The site visit conducted by Komnas HAM showed that shackling, confinement, and various forms of exclusion are still the most common method used for PMDs in all the visited rehabilitation centres. 37. The commission also found that it was a common practice for male caregivers to handle women PMDs, doing everything from changing their clothes to bathing them, a practice that may pose a risk of sexual harassment and violence against female PMDs. Komnas HAM also came across a rehabilitation centre in which a PMD was locked in a 1 x 2 meter room, where the said individual was expected to eat and use the toilet in the same place.21 38. Komnas HAM also found supposedly medical procedures performed by rehabilitation centre staff when PMDs were administered psychotic medications without prior mental health examinations, all of which should have been carried out by professional medical personnel.
