54. Provide the result of recent human rights compliance survey of the government on
residential facilities for persons with disabilities, the yearly statistical data on the number of
complaints filed with analysis on forms of abuse including violence, exploitation, and forcedlabor and etc. inflicted on persons with disabilities, the number of victimized persons with
disability, the number of remedial measures adopted and their details, the number of abused
persons with disabilities who used shelter service, and the details of the government’s plan to
support abused victim’s rehabilitation to the society.
55. Provide information on the status of violence, exploitation, abuse, delayed payment of wage
inflicted on persons with disabilities, who are living outside residential facilities for persons with
disabilities, or working in private enterprises employing persons with disabilities; also provide
information on the government’s policy and plans to protect the rights of persons with disabilities.
Article 19- Living Independently and Being Included in the Community
Current status
56. According to the recent press release (22 August 2017, Segye Daily and 19 December
2017, Incheon Daily), persons with severe disabilities and women with disabilities raising an
infant are facing great difficulties in subscribing to personal activity assistance services for
persons with disabilities, as personal assistants are avoiding assignment to these groups.
Despite the difficulty in hiring assistant, the Act on Activity Assistant Services for Persons
with Disabilities (AAASPD) does not recognize family members as the legal personal
activity assistant who could claim activity support allowance. Unless persons with disabilities
resides in an area which the Minister of Health and Welfare recognizes its extremely
insufficient availability of institutions providing activity support, the role of personal activity
assistant is effectively withheld from family members.
57. According to the Ministry of Health and Welfare, the number of eligible hours for activity
assistance service ranges from 47 hours to 720 hours per month depending on the person’s
disability rating and the financial condition of local government. With consideration to the
difference in amount of service offered, a number of cases of moving into an administrative
district which offers more services were observed.
