Our regulatory functions
As of 12 December 2023, the Commission
is responsible for monitoring and assessing
compliance with the positive duty in section 47C
of the Sex Discrimination Act 1984 (Cth).
The Commission’s regulatory functions under
the AHRC Act include:
• to inquire into a duty holder’s compliance
with the positive duty
The Commission has published a Statement
of Intent on its website that outlines how it
will deliver on the Minister’s expectations with
respect to fulfilling its statutory responsibilities.
The Commission has also published its
Compliance and Enforcement Policy to provide
simple and clear information about how the
Commission intends to perform its functions in
relation to the positive duty.

acceptance, and public discussion, of the
positive duty
• to undertake research and educational
programs in relation to the positive duty.
